Examinership
Examinership is a process whereby the protection of the High Court is obtained to assist an examiner to formulate a scheme of arrangement for the survival of a company. It allows a company to restructure and is an alternative to winding up a company in financial difficulties. However, there are certain criteria a company needs to meet to be successful in an examinership.
We can act as examiners and can also prepare the Independent Accountant's Report that is required to place a company into examinership.
Receivership
A receiver is usually appointed by a secured creditor. A receiver is appointed when an event of default has occurred under the terms of the debenture which means that the security has become enforceable. The powers of a receiver are to manage the business of the company, and to realise its assets to repay the debenture holder who appointed them.
We are able to advise on all aspects of receivership and to act as receivers.
